Overview

Michael Padula, a seasoned trial attorney, defends companies and individuals in matters involving white collar crime, government investigations, and civil litigation. His practice focus includes the Bank Secrecy Act, accounting fraud, anti-money laundering, OFAC compliance, and the Foreign Corrupt Practices Act.

As a trial attorney with the Criminal Division of the U.S. Department of Justice in Washington, D.C., he prosecuted white collar domestic and international criminal cases and conducted investigations against financial institutions and their officers, managers, and employees for violations of the Bank Secrecy Act. Michael investigated and prosecuted high-end international money laundering cases, including those involving virtual currencies, government-issued bonds, and the Black Market Peso Exchange. He also handled numerous cases involving the FCPA and securities fraud and conducted parallel investigations with FINRA, OFAC, and other regulatory agencies. Michael’s insider perspective and understanding of the DOJ’s operations are an asset to clients on matters related to compliance, regulatory issues, investigations, and high-stakes litigation.

Before founding Padula Law, Michael investigated and prosecuted large-scale Ponzi schemes, bank and wire fraud, and health care fraud cases as a special assistant U.S. attorney in the Southern District of Florida. He was instrumental in the investigation and conviction of a former CEO who defrauded multiple banks and 1,400 investors in a $300 million Ponzi scheme.

Michael also investigated and prosecuted Medicare fraud cases, indicting numerous defendants in a multistate sting operation involving more than $16 million in fraudulent Medicare billings related to home health care claims.

In addition to his public service, Michael has extensive civil litigation experience, including matters involving high-profile antitrust filings and litigation, complex insurance recovery litigation, and price fixing.

Experience

  • Investigated and prosecuted complex white collar domestic and international criminal cases, with a focus on financial institutions and their officers, managers, and employees.
  • Indicted a large-scale international money laundering conspiracy, which spanned multiple countries and included a forfeiture allegation seeking $1.3 billion.
  • Investigated and prosecuted all forms of money laundering, including the use of virtual currencies, government-issued bonds, and the Black Market Peso Exchange.
  • Issued global subpoenas to financial institutions, compelling the testimony of witnesses and production of documents.
  • Conducted parallel investigations with the Securities and Exchange Commission (SEC), the Financial Industry Regulatory Authority (FINRA), the Office of Foreign Asset Control (OFAC), and other regulatory agencies.
  • Managed a corruption investigation of a foreign official, which included witness interviews and coordination with other regulators in a parallel civil action.
  • Selected for detail to the U.S. Attorney’s Office for the Eastern District of Virginia as a special assistant U.S. attorney. Led investigations of felonies, including bank fraud, wire fraud, and perjury.
  • Obtained several grand jury indictments and supervised production of discovery materials in multi-defendant cases related to Medicare fraud.
  • Prosecuted and investigated Foreign Corrupt Practices Act (FCPA) cases, concentrating on the health care and medical device industries.
  • Indicted numerous defendants as part of a multi-state sting operation involving health care fraud investigated by the FBI and the Department of Health and Human Services Office of Inspector General. Presented the grand jury indictment, which involved more than $16 million in fraudulent Medicare billings related to fraudulent home health care claims.
  • Conducted a grand jury investigation into potential violations of the FCPA by an international corporation.
  • Conducted multiple FCPA investigations as part of an industrywide probe into the marketing practices of international medical device companies. Evaluated and assessed the facts provided by corporate counsel regarding the investigations in Brazil, Argentina, Greece, and Poland. Worked with the SEC on a parallel civil investigation into the alleged violations.
  • Managed the use of electronic surveillance in cases involving securities fraud, insider trading, public corruption, and domestic terrorism.
  • Coordinated the use of wiretaps in an insider trading investigation into hedge fund managers receiving and trading material, nonpublic information.
  • Advised on the use of electronic surveillance techniques in a multiyear public corruption investigation, which resulted in the arrest and conviction of multiple public figures.
